As I have paid my road tax why cant I park on the road? The council should not control parking on the highway.
The “road tax” is properly called “vehicle excise duty”. It is a duty paid direct to the Government like tobacco, alcohol and fuel duties. It does not grant any rights on the highway.
There is no right in law to park on an uncontrolled highway and the only right that a vehicle-user has on the highway is the right in Common Law to pass along it.
The council is empowered to control parking by Act of Parliament and we do this for traffic management and parking management purposes.
