Statutory Officers: Monitoring Officer

The role of 'Monitoring Officer' is a statutory role. At the London Borough of Barnet, the role of Monitoring Officer is fulfilled by the Director of Corporate Governance. The present holder of this post is Mr Jeff Lustig.
It is also statutory that a Deputy Monitoring Officer be appointed and the Head of Legal fulfils this.
The Monitoring Officer is appointed under the Local Government and Housing Act 1989 and the role has been substantially expanded due to extra functions assigned under the Local Government Act 2000 and the Local Government and Public Involvement in Health Act 2007. The Council is obliged to provide him with such officers, accommodation and other resources as are in its opinion sufficient to allow his duties to be performed.
The duties of the Monitoring Officer include supporting the Standards Committee, in particular in its local regulation of allegations that a Member of the Council has breached the Member Code of Conduct
(PDF 40KB) and fulfilling the requirements of the Standards Board for England. He also maintains the Council Constitution, ensures lawfulness and fairness of decision-making by the Council, its Executive and Committees, and is the proper officer for Access to Information.

The individual who holds the position of Monitoring Officer for the Authority can not also hold the postion of either the Head of Paid Service (Chief Executive) or the Chief Finance Officer.
