The Government recently published the National Planning Policy Framework (NPPF) on the 27 March and a Planning Policy for Traveller Sites. Copies of these documents can be found at:

Further advice was released on 16 April on the Government’s Planning Portal website which emphasises the need for plans to reflect the presumption in favour of sustainable development

- Planning Reception, Barnet House, 1255 High Road , London N20 OEJ; and
- all public libraries in Barnet
As part of the Examination in Public (EIP) you can if you wish, make representations on the matters raised in these documents as far as they relate to the Barnet Core Strategy and Development Management Development Plan Documents (DPDs), please respond to the Programme Officer (contact details on the right) by 5pm on Wednesday 16 May 2012.
The Council has stated that it intends only to make necessary changes to both documents caused by the release of these documents, that is, replacing references to former Planning Policy Statements and Planning Policy Guidance with a reference to the new NPPF.
The EIP Inspector will release his report after having received any representations raised on the NPPF.

Examination in public (EIP)
The hearing sessions took place from 6 December to Wednesday 14 December 2011. It was held in Committee Room 2 at Hendon Town Hall.
Appointed inspector
The Secretary of State appointed Inspector Vincent Maher to conduct a joint examination in public for Barnet’s Core Strategy and the Development Management Policies. The role of the inspector and purpose of the examination was to consider whether these documents were legally compliant and satisfied the criteria for soundness. The next task of the inspector will be to produce a report with recommendations that are binding upon the council.
Programme officer
The programme officer appointed for the Examination in Public (EiP) was Ms Vijaya Ram. She corresponded directly to the planning inspector and was responsible for dealing with all the administration matters for the examination.

Legal opinion on not duly made objections
The consultation of May - June 2011 focussed on specific changes to the core strategy as set out in the accompanying document pre-submission amendments. Technically, at this stage of core strategy consultation, the council is only obliged to respond to representations relating to specific core strategy amendments.
The council's consultation letter of 11 May 2011 clearly stated that the pre-submission amendments have been produced to resolve objections made to the previous stage of the core strategy and provided an opportunity for those who have made objections to withdraw their comments. This will enable the inspector at the EiP to focus on areas of contention. Comments that are not related to the listed changes in the Core Strategy Pre-Submission Amendments document have not been considered.

The council made a request for legal opinion on 'not duly made representations' on 9 September 2011.
Comments that did not relate to the pre-submission amendments were considered to be 'not duly made' and this is supported by legal opinion.
Examination document library
The document library is a live document and will be updated as and when required. An examination core document library lists all the relevant material that the council will rely on at the examination hearings. Due to the launch of the new web site, documents in the examination library are currently only available as 'hard copies'. Electronic versions of these documents will be available as soon as possible.
The pre-examination amendments have now been added to the core document library. These amendments can be viewed directly.

Statement on draft National Planning Policy Framework
Conformity with Core Strategy and Development Management Policies
The inspector has requested views on the draft national planning policy framework and the implications of this policy development for the core strategy and development management policies documents. The council considers that the core strategy and development management policies documents are in general conformity with the draft NPPF.

National Planning Policy Framework update
The National Planning Policy Framework (NPPF) was published on the 27 March 2012. The policies in the Framework apply with immediate effect. The Government has stated that the aim of the document is to make the planning system less complex and more accessible, to protect the environment and to promote sustainable growth.

The Inspector has asked the Council to give him clarification as to whether they will make further modifications to the Core Strategy and Development Management DPDs in response to the publication of the NPPF.
Statements of common ground between the council and representors
Mayor of London’s statement of conformity
It is a requirement under the Planning and Compulsory Act 2004 that Local Development Documents from all London boroughs must be in general conformity with the London Plan at the point of their adoption. The core strategy and the DPDs are in general conformity with the London Plan.
