About this notice
London Borough of Barnet (LBB) core data protection obligations and commitments are set out in the council's Privacy notices.
This notice provides additional privacy information for victims and perpetrators of domestic abuse and sets out what we will do with your personal information and who we may share it with in respect of the above.
Why we use your information (Purposes)
We use your information to:
- Help keep you and others safe
- Provide advice, support and referrals in relation to domestic and sexual abuse
- Work with other services to reduce the risk of harm
- Carry out safeguarding duties for adults, vulnerable adults and children
- Contribute to Domestic Homicide Reviews so lessons can be learned and future deaths prevented
We only use your information when it is necessary and lawful for us to do so.
What information we collect and from where
Depending on your situation, we may collect:
- Basic details: name, address, contact details
- Special category information: ethnicity, health information, details about any abuse or risk
- Information about crimes that have been committed
- Housing circumstances and information about other agencies supporting you
- For Domestic Homicide Reviews, we may receive information from family, friends, colleagues, and partner agencies who had contact with those involved.
Our legal reasons (lawful basis) for using your information
We use your information under the following legal bases:
Article 6 (UK GDPR)
- Consent (6(1)(a))- For some referrals (e.g., to support services or MARAC), we will ask for your consent. You can withdraw consent at any time.
- Legal obligation (6(1)(c)) - We must process certain information to comply with the Domestic Violence, Crime and Victims Act 2004 and the Domestic Abuse Act 2021.
- Public task (6(1)(e) - We process information to carry out our duties to protect people and prevent harm.
Article 9 (special category data)
- Explicit consent (9(2)(a))
- Substantial public interest (9(2)(g)- For safeguarding, preventing crime, and protecting vulnerable people.
Article 6 1(e) Public task
Without processing the relevant personal data, we would not be able to perform tasks carried out in the public interest, or in the exercise of our official authority.
Under 6 1(e) MARAC referrals, minutes and actions plans, relevant case notes, self-referrals are processed when it is necessary to do so for compliance with a legal obligation to which we are subject.
Special Category data will be processed under Article 9 2(a) and Article 9 2(g) of the UK General Data Protection Regulation. Article 9 2(a) relates to the data subject giving explicit consent to the processing of special category data for one or more specific purposes. Article 9 2(g) refers to special category data being processed where necessary for reasons of substantial public interest, on the basis of domestic law.
Who we share your information with
We only share your information when it is necessary, proportionate and lawful.
We may share information with:
- MARAC partner: when you are at high risk of domestic abuse (sometimes even without consent if required to keep someone safe)
- The police: for crime prevention, detection, or safeguarding
- Specialist domestic abuse providers
- Other organisations when needed to safeguard you, others, or prevent a crime.
No automated decision making
All decisions about you involve a human being. We do not use automated decision making.
How long we keep your information
We keep your information in line with relevant legislations, recognised local government retention standards and the Council’s retention Schedule:
- Adults: 10 years after closure date
- Children: 10 years after closure date
- Adopted children: 100 years after closure date
Your rights
You can ask for the information we have about you by making a Subject Access Request.
